HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 18302 of 2017 ORDER:

1) The present writ petition came to be filed challenging the proceedings No.L/ 687/ 2017 dated 09.05.2017 issued by the second respondent in directing the third respondent to seize the property belonging to the petitioner bearing H.No.5-1009/ 2 situated at Father Balaiah Nagar, Old Alwal, Secunderabad. 2) Learned counsel for the petitioner would submit that the petitioner has nothing to do with Crime No. 263 of 2017 of Alwal Police Station, registered under Section 370 (A) IPC and Sections 3, 4, 5 and 6 of the Prevention of Immoral Traffic Act, 1956. The premises was let out to a tenant and the tenant has misused the same. Since the tenant has vacated the premises and he is no longer residing there, there is no need for keeping the premises under lock and key.

3) The said facts have to be taken into consideration by the second respondent, and for the said purpose, liberty is given to the petitioner to submit a representation basing on the order dated 09.05.2017 within one week from the date of receipt of a copy of this order and on receipt of such representation, the second respondent shall pass appropriate orders, in accordance with law, within two weeks thereafter.

4) Accordingly, the writ petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C. PRAVEEN KUMAR 08.06.2017 gkv
