HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22423 OF 2009 O R D E R :

This writ petition is filed challenging the order dated 19.09.2009 in Case No.D2/25/2008 and File No.D2/3896/2005 passed by the Joint Collector, Nizamabad-1st respondent wherein the 1st respondent directed the Tahsildar to cancel the pattadar pass book and title deed issued in favour of the petitioner, who is the 1st respondent in the Revision filed by the respondents 3 to 6 and consequentially directed to issue pattadar pass book and title deed in favour of the respondents 3 to 6 by incorporating their names in the pahanies in place of the petitioner. Heard the learned counsel for the petitioner and the learned counsel for the respondents 3 to 6.

The first respondent allowed the Revision petition by observing that the petitioner herein who is the respondent before the Joint Collector-1st respondent herein in the Revision failed to produce any valid documents to claim the property and it is also observed that no enquiry was conducted by the Tahsildar as prescribed by ROR Act. The petitioner also stated in para 7 of the writ affidavit all the relevant documents were not available. In view of the same, I do not see any merit to entertain the writ petition. Accordingly, the writ petition is dismissed. However, this order will not preclude the petitioner from availing remedy under Section 8(2) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971. No costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
