THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6635 OF 2023 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioners - Accused Nos.2 and 3 seeking bail in the event of their arrest in connection with Crime No.459 of 2022 on the file of Jadcherla Police Station, Mahbubnagar District registered for the offences punishable under Sections 419, 420, 467, 468, 109 of Indian Penal Code and Section 82 of Registration Act.

Heard Sri Jillela Rajeshwar Rao, learned counsel for the petitioners - A2 and A3 and learned Additional Public Prosecutor, representing the State.

The case of the prosecution is that a complaint was filed on 07.03.2022 alleging that in the month of April, 2021, one Chandramouleshwar died. After his death, fake Aadhar Cards were prepared and plots were registered in favour of third parties.

The petitioners are shown as purchasers of the said plots by registered Sale Deeds which were executed prior to
the month of April, 2021.
The said seller, Chandramouleshwar, died in the month of April, 2021. Since the Sale Deeds executed in favour of the petitioners are prior to his death and also for the reason of the petitioners filing a suit in O.S.No.16 of 2022 and the Civil Court granting interim orders in their favour, the benefit of anticipatory bail can be extended to these petitioners. 5.
Accordingly, the Criminal Petition is allowed and the petitioners herein are granted anticipatory bail subject to the following conditions:
(i) The petitioners/accused Nos.2 and 3 are directed to surrender before the Jadcherla Police Station, Mahbubnagar District, within a period of two (2) weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on their executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties each to the like sum each to his satisfaction.
(ii) The petitioners/accused Nos.2 and 3 shall appear before the Station House Officer, Jadcherla Police Station,
Mahbubnagar District, every Monday between 10.00 AM and 5.00 PM for a period of eight (08) weeks. (iii) The petitioners/accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. and co-operate with the Investigating Officer in investigating the case.
