The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in recording the petitioner's date of birth as 19.11.1955, in place of 19.03.1956, as illegal and arbitrary and consequently direct the respondents to continue the petitioner in service till 31.03.2014, on which date the petitioner would attain the age of superannuation.

Today, at the time when the matter is taken up for hearing, it is represented by the learned Standing Counsel for respondent-Corporation that all the retirement benefits are settled, pursuant to the interim orders passed by this Court on 14.06.2013 and thereafter, the petitioner also passed away. 4.
Having regard to the above, no further orders are necessary in the writ petition and the writ petition is closed. If there is any dispute with regard to the payments made, the legal heirs of the petitioner/ deceased employee are at liberty to take steps in accordance with law. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
