ORDER
This Criminal Petition is filed under Section 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') seeking grant of bail to the petitioner, who is arrayed as sole accused in Crime No.735 of 2026 of Medipally Police Station, Malkajgiri District, registered for the offences punishable under Section 78 of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The brief facts of the case are that the de-facto complainant had a relationship with her classmate i.e., the petitioner/accused herein, for the past six years. In the year 2023, she came to know that the petitioner/accused was having a relationship with another girl, due to which
she ended the relationship. However, thereafter, the accused continued to follow her and threatened that he would post her photos on social media. Due to his harassment, she lodged a complaint against him in Medipally Police Station vide Cr.No.592 of 2024 under Sections 354D and 506 of the Indian Penal Code. Despite the registration of the case, the accused continued to follow and harass the de-facto complainant that he would contact her parents and friends. In the month of February-2026, the petitioner allegedly posted the de-facto complainant's photos on his WhatsApp status and also sent messages to her through Phone-Pe number - 8143241998. Thus, basing on the complaint, the police authorities have registered the present case under Section 78 of the BNS, arrested the petitioner/accused on 21.05.2026, and remanded him to judicial custody, and since then, he is longing in the judicial custody. 3.
Heard Mr. A.G.Vishveshwar Rao, learned counsel for the petitioner and learned Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the case, and that the petitioner is willing to co-operate with the investigation and to abide by any
conditions that may be imposed by this Court. Hence, the present Criminal Petition has been filed.

On the other hand, the learned Public Prosecutor opposed the submissions made by the learned counsel for the petitioner as well as for grant of bail stating that specific allegations are levelled against the petitioner.

In the light of the submissions made by both the learned counsel and on a perusal of the material on record, it is evident that the petitioner is in judicial custody since 21.05.2026. Admittedly, in the instant case, the offence alleged is punishable up to three (3) years. Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner/accused, subject to the following conditions:
(i) The petitioner/accused shall be released on bail on his executing a personal bond for Rs.20,000/- with two sureties for the like sum to the satisfaction of the learned Principal Judicial-cumChief Judge cum IV Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District, at Medipally. (ii) The petitioner shall abide by the other conditions stipulated in Section 480(3) of Bharatiya Nagarik Suraksha Sanhita, 2023
and co-operate with the Investigating Officer in investigating the case.
(iii) The petitioner shall appear before the concerned Investigating Officer on every Sunday between 09:00 a.m. and 12:30 p.m., for a period of six (6) weeks or till the filing of the charge sheet, whichever is earlier and thereafter as and when required. 7.
