Heard the learned counsel for the petitioners as well as the respondents.
The present writ petition is filed questioning the demand notice dated 21.09.2006 and 04.01.2007 issued under Section 13(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short 'SARFAESI Act') and subsequent possession notice, dated 05.03.2007 issued under Section 13(4) read with Rule 9 of the Security Interest (Enforcement) Rules, 2002 by respondent No.2, as arbitrary, illegal and without jurisdiction.
Learned counsel appearing for the petitioners requested the Court to permit him to withdraw the writ petition giving liberty to approach the authorities concerned to avail the remedies available.
Accordingly, the writ petition is dismissed as withdrawn giving liberty to the petitioners to approach the authorities concerned to avail the remedies available to them as per law. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
