HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Civil Revision Petition No.1417 of 2017 ORDER:

This CRP is filed against the order dated 10.02.2017 in I.A.No.1791 of 2016 in O.S.No.217 of 2007 on the file of Senior Civil Judge, Proddatur wherein the trial Court allowed the petition filed by the respondents/plaintiffs under order IX Rule 9 CPC and restored the suit on file on payment of costs of Rs.500/- to Mandal Legal Services Authority on or before 16.02.2017.

2) Heard learned counsel for petitioner Sri K.Mahipathi Rao and learned counsel for respondents Sri K.Srinivas.

3) As can be seen, the order impugned was passed by the trial Court having been satisfied with the reasons assigned by the respondents/plaintiffs for their non-appearance before the Court on the day when the matter was called and accordingly restored the suit.

4) Having found no perversity in the order impugned, the CRP is dismissed confirming the said order of the trial Court. 5) Having regard to the fact that suit is of the year 2007 the trial Court is directed to dispose of the suit on merits within a period of four months from the date of receipt of copy of this order. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
