THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4846 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.5 to 8 in the event of their arrest in Crime No.137 of 2021 on the file of Station House Officer, Narayanapur Police Station, Yadadri-Bhongir District, registered for the offence punishable under Section 326 read with Section 34 of Indian Penal Code.

Heard learned counsel for petitioners/Accused Nos.5 to 8 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case of the prosecution is that on 01.08.2021 the de facto complainant lodged a complaint stating that these petitioners who are Accused Nos.5 to 8 and the other Accused Nos.1 to 4 and 9 attacked him by caught holding of his hands and thrown chilli powder into his eyes, beat with sticks and later all they left the scene.

Learned counsel for the petitioners submits that, even according to the complaint, there are no specific allegations against these petitioners. He further submits that the other Accused Nos.1 to 4 were arrested and released on bail.

In the said circumstances, as there are no specific overtacts attributed to these petitioners, the petitioners/Accused Nos.5 to 8 can be granted the relief of anticipatory bail. 6.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.5 to 8 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.5 to 8 are directed to surrender before the Station House Officer, Narayanapur Police Station, Yadadri-Bhongir District within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.5 to 8 shall appear before the concerned Station House Officer on every 1st and 3rd Mondays between 10.30 AM and 01.00 PM for a period of three (03) months.

iii) The petitioners/Accused Nos.5 to 8 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 7.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
