Guthikonda Parvathi Vara Prasada Rao, v. The National Highways Authority Of India,
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 13613 of 2015 Date of Judgment: 1.6.2015 Between:
Guthikonda Parvathi Vara Prasada Rao and others
...Petitioners
And The National Highways Authority of India, New Deli and others ..Respondents THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 13613 of 2015 ORDER:
Heard learned counsel for the parties.
The petitioners state that during the life time of their father, acquisition proceedings with regard to Sy.No. 370/P of Kaza village, Mangalagiri Mandal, Guntur district were taken up, but no compensation was paid either to the petitioners' father or to the petitioners. They also state that in the year 2013 possession of the land was taken over by the respondents and in spite of their representation dated 5.8.2013 addressed to the District Collector, no
information is being furnished to them. Hence the present writ petition is filed declaring the action of the respondents in dispossessing the petitioners without acquiring their land in accordance with law as illegal.
The present writ petition is filed two years after the possession was taken and it is apparent from the averments of the writ affidavit that the petitioners seek to fish out information from the respondents to enable them to take appropriate steps. In my opinion, the process of this Court for that purpose cannot be used and unless the petitioners come out with a specific case, their grievance cannot be considered. Further the petitioners have an effective mechanism under the Right to Information Act for obtaining the information, which is not availed by the petitioners.
Hence on the basis of the insufficient vital information, I am not entitled to entertain this writ petition which is accordingly dismissed along with miscellaneous applications, if any. There shall be no order as to costs.
