HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.18979 of 2017 ORDER:

The petitioner prays for the following relief: " ....writ of mandamus or an appropriate writ or order declaring the high handed action of the respondents 3 to 5 in attempting to measure the land and partition the same to an extent of 0.25 cents in Survey No.298/ 1, Thimmareddypalem village, Lingasamudram Mandal, Prakasam District, without notice and without any authority of law with a view to benefit the 6th respondent, as illegal, arbitrary and unconstitutional" .

2. The Assistant Government Pleader (Revenue) for respondents 1 to 5, opposed the writ prayer, firstly, by contending that the writ petition is filed on mere apprehension, and secondly, that respondents 3 to 5, at any rate are under obligation to issue notice to the persons interested in the subject matter of survey and the neighbouring lands. Therefore, the respondents at any point of time, if a request comes forward for survey, will follow the procedure and conduct the survey. The statement is placed on record. The petitioner is given liberty forthwith to communicate this order to respondents 3 to 5 and to act accordingly.

3. The writ petition is, disposed of, as indicated above. No order as to costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed.
