THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.17140 of 2017 ORDER :
Heard the learned counsel for the petitioner and also Sri A.Ravibabu, learned Standing Counsel for the respondentsTSRTC, and perused the Writ Petition prayer, supporting affidavit and other material on record.
There is an agreement for 5 years under licence for running Supermarket, Lodge & Food Court by the petitioner vide allotment letter No.E5/ 122(32)/ 2016-RM-KR dt.18.04.2016 up to 24.04.2021. It is the case of the petitioner that there is also a supplementary agreement for additional place in addition to the place covered by the original agreement by permitting additional accommodation under the license by the supplementary agreement.
The grievance of the petitioner is that the 3rd respondent issued an advance notice for termination dated 04.04.2017 of supplementary agreement cancellation of the additional accommodation and trying to take away illegally before expiry of the period.
It is the submission of the learned Standing Counsel for the respondents-TSRTC that pursuant to the advance termination notice, already terminated and the possession is resumed. It is the case of the petitioner that he invested and incurred huge amounts bonafide.
Having regard to the above, the Writ Petition is disposed of by giving liberty to the petitioner to make a written
representation to the respondents for providing alternate additional accommodation pursuant to the termination of license before the period of its expiry as a substitute to the part of original licence area taken away to the extent possible to relieve his sufferance.
Consequently, miscellaneous petitions, if any, pending shall stand closed.
