This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioners/accused Nos.1 to 11 in Crime No.96 of 2018 on the file of the Station House Officer, Kandukur Police Station, Ranga Reddy District, registered for the offences punishable under Section 323 I.P.C. and Section 3(1)(r)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

At the time of arguments, the only relief sought by the learned counsel for the petitioners is to direct the concerned Station House Officer to follow the procedure as contemplated under Section 41A Cr.P.C.

In view of the submission made by the learned counsel for the petitioners, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case and also the principle enunciated by the Supreme Court in Arnesh Kumar v. State of Bihar1, the Station House Officer, Kandukur Police Station, Ranga Reddy District, is hereby directed to follow the procedure as contemplated under Section 41A Cr.P.C. in Crime No.96 of 2018 so far as the petitioners/accused Nos.1 to 11 are concerned.

With the above direction, the Criminal Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
