This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: " to issue a writ order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in not dispose of the representation of the petitioner Dt.02.05.2017 for consideration of grant of license to run restaurant in the 2nd respondent State Gallery on the petitioner's name is illegal, arbitrary and in violation of principles of natural justice, consequently direct the 2nd respondent to dispose of the representation of the petitioner dt.02.05.2017 for consideration of grant of license to run restaurant in the 2nd respondent State Gallery on the petitioner's name, and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Heard the learned counsel for the petitioner and the learned Government Pleader for Tourism for respondents 1 and 3 and the learned Standing Counsel for respondent No.2 offers to file vakalat saying got instructions and perused the material on record. The only grievance of the petitioner is that his representation dated 02.05.2017 is pending disposal without passing any orders.
The learned Government Pleader undertakes to pass orders on merits on the representation of the petitioner and also stated that there is another writ petition also pending in relation to the license with regard to the partnership firm.
Having regard to the above, this Writ Petition is disposed of directing the 2nd respondent to dispose of the representation of the petitioner on its own merits, within two weeks from the date of receipt of copy of this order by affording opportunity of hearing the petitioner.
Consequently, miscellaneous petitions, if any, pending shall stand closed. No costs.
