HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.25618 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer in Yettigadda Mandapur Village, Medak District. The petitioner's authorization was suspended on 24.11.2014, and a show cause notice was issued to him. After receipt of show cause notice, the petitioner submitted his explanation on 09.04.2015. Thereafter, the matter was referred to the Tahsildar, Kulcharam Mandal for enquiry by the third respondent on 23.04.2015. After receipt of report of the enquiry by the Tahsildar, Kulcharam Mandal, dated 19.05.2015, the third respondent did not pass any order. Hence the Writ Petition.

Learned counsel for the petitioner submits that the fourth respondent, in his report dated 19.05.2015, stated that the allegations against the petitioner were not correct, and the villagers requested for restoration of authorization in favour of the petitioner.

This Court is not inclined to comment on the merits of the case when the enquiry is pending before the third respondent. In the circumstances, the third respondent is directed to complete the enquiry against the petitioner, and pass final orders thereon, after taking into consideration the report of the Tahsildar, Kolchapur Mandal, dated 19.05.2015, within a period of thirty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition
