ORDER:

This Court disposed of the W.P.No.11562 of 2014 on 18.06.2014 directing the second respondent University to consider the representation submitted by the petitioner on 21.02.2014, which was addressed to the Principal, Manisha College of Nursing, Visakhapatnam, and to take a decision on the request of the petitioner and communicate the decision to the petitioner within a period of two (2) weeks. Alleging that the order of this Court is not complied, this contempt is filed.

2. Along with the counter affidavit filed on behalf of the 2nd respondent, a copy of the letter of the University of September, 2014, is enclosed wherein the petitioner was informed that unless M.Sc (Psychiatry Nursing) admission is approved, her dissertation topic cannot be registered with the University.

Earlier, the matter was adjourned on the contention of the learned counsel for the petitioner that the socalled decision of the University was not communicated to the petitioner.

3. Learned Standing Counsel produced the correspondence emanating from the Manisha College of

Nursing. According to the letter of the Vice Principal of Manisha College of Nursing, dated 03.12.2015, the petitioner was informed of the decision of the University by announcing in her presence and in the presence of other students of her batch; copy was also served and the intimation was displayed on the notice board. According to the Vice Principal, the letter was served by Professor Mrs. B.D.Florence Nightingale, who was then Principal of Manisha College of Nursing, Visakhapatnam.

4. Having regard to the said statement, it cannot be said that the copy of the order is not served. Be that as it may, the direction of this Court was to consider the request of the petitioner and take a decision and the decision is already taken. Hence, there is no case for proceeding against the respondents under the Contempt of Courts Act, 1971.

5. The Contempt Case is, accordingly, closed, leaving it open to the petitioner to work out her remedies. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed. _________________ P.NAVEEN RAO, J Date: 4th December, 2015 KL
