THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.18837 OF 2017 ORDER:

This Writ Petition is filed for the following relief. "...to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus, declaring the action of the respondents 2 to 5 in trying to demolish and interfere with the peaceful possession and enjoyment of the portion of the writ petitioner's property in Survey No.254/2 of M.Agraharam Village, Maddekera Mandal, Kurnool District without issuing any notice or following due process as contemplated under is illegal, arbitrary, high handedness and violation of principles of natural justice and consequently direct the respondents 2 to 5 not to interfere with the peaceful possession and enjoyment of the portion of the writ petitioner's property in Survey No.254/2 of M.Agraharam Village, Maddekera Mandal, Kurnool District...".

Now, a counter affidavit is filed by the fifth respondentPanchayat Secretary stating that the petitioner is the owner of the land admeasuring Ac.0.10 cents situated in survey No.254/2 of M.Agraharam Village, Maddikera Mandal, Kurnool District and the Gram Panchayat is not interfering with the petitioner's possession and enjoyment of the said land. The Gram Panchayat decided to lay a pipeline in the road margin without touching any constructions in the colony or the land of the petitioner. In view of the above submission, no further orders are necessary in the present Writ Petition.

Accordingly, the Writ Petition is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
