ORDER:
This Civil Revision Petition is filed invoking the supervisory jurisdiction of this Court under Article-227 of the Constitution of India feeling aggrieved by non-disposal of I.A.No.1480 of 2013 in O.S.No.2000 of 2013 on the file of learned VIII Senior Civil Judge, Ranga Reddy District at L.B.Nagar.
The petitioner filed the above-mentioned suit for permanent injunction against the respondents. Pending the suit, he has filed I.A.No.1480 of 2013 for temporary injunction. The grievance of the petitioner is that the said application is not being disposed of by the lower Court. At the hearing, Sri R.K.Suri, learned counsel for the petitioner, submitted that as notices could not be
served on some of the respondents/their legal representatives, the lower Court is not taking up the I.A. for passing of final order.
In my opinion, when once notices are issued, the petitioner has to ensure that they are served on the respondents. The lower Court cannot be found fault with for not disposing of the I.A. before service of notices. In this view of the matter, the lower Court is directed to ensure that notices are served on the respondents either personally or through substituted service in a time bound manner and the I.A. is disposed of within three months from the date of service of such notices.
Subject to the above directions, the Civil Revision Petition is disposed of.
As a sequel to disposal of the Civil Revision Petition, CRPP.No.6276 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
