HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION Nos.29570, 26348 of 2010 and 13363 of 2011 COMMON ORDER:

Since the issue involved in all these writ petitions is one and the same, they are heard together and are being disposed of by this common order.

These writ petitions are filed by the petitioners challenging the action of the official respondents in not entertaining their applications for layout regularization in their favour in respect of the property in question, and further, challenging the action of the official respondents in granting layout regularization in favour of the unofficial respondents in respect of the property in question.

On 1.2.2011 while admitting Writ Petition No.29570 of 2010, this Court suspended the proceedings dated 21.10.2010 issued by the 1st respondent, under which layout regularization was granted in favour of respondents Nos.3 to 8 in respect of the property in question. While suspending the said order, this Court directed that neither the petitioners nor the contesting respondents shall undertake any construction activity over the land in question, and that the compound wall existing in the land shall not be demolished.

When these matters have been taken up, the learned Counsel for the petitioners submitted that the petitioners sought remedy before the Civil Court by filing O.S.No.132 of 2010 before the III Additional District Judge, Warangal, in order to establish their rights over the property in question. While submitting so, the learned Counsel for the petitioners prayed that the

interim order passed by this Court may be continued till disposal of the suit.

Recording the above submission, the Writ Petitions are disposed of. However, in the circumstances of the case and in view of the fact that the interim order passed in WPMP No.37666 of 2010 in W.P.No.29570 of 2010 on 1.2.2011 is still in force, and in view of the pendency of the suit as well the writ petitions over the property in question since 2010, it is just and proper to continue the said interim order till disposal of the suit in order to avoid the multiplicity of proceedings. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. _________________ Justice Raja Elango Dated: 23.2.2017.
