Devi Reddy Shiva Shankar Reddy, v. The State Of Ap Rep By Its Pp Hyd., And Another,
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.6 6 6 2 of 2 0 1 1 ORDER:
This petition is filed seeking for quash of the proceedings against the petitioner-A.7, in Crime No.78 of 2011 on the file of Pulivendula Urban Police Station, Kadapa District. 2.
Heard the learned counsel for the petitioner and learned Public Prosecutor for first respondent. None appears for the second respondent, in spite of notice.
3.
Learned counsel for the petitioner contends that there are absolutely no allegations in the complaint against the petitionerA.7, attracting any of the offences alleged against the accused. 4.
A perusal of the complaint shows that one Sunil Kumar, who is nephew of the complainant, during holidays, came to the house of complainant at Pulivendula. There is friendship between sunil Kumar and one Patra Navin. On 19.6.2011 said Navin eloped with a girl by name Asma, hailing from Islampura of Pulivendla, but Sunil Kumar-nephew of complainant was not aware of the said fact. On 21.06.2011, the parents of the said girl took his nephew to one Shankar Reddy, who is the petitioner herein, who enquired with nephew of complainant and advised him to enquire about the whereabouts of said Navin Kumar and the girl and produce them before him, for which, he pleaded ignorance of whereabouts of said Navin Kumar and the girl, but the people, who were present with the petitioner-A.7, expressed
that if the nephew of the complainant is left with them for one hour, they would sort out the issue, but the petitioner herein warned those persons and asked the nephew of the complainant to enquire the whereabouts of the said Navin Kumar and the girl. Hence, from the above allegations, it does not appear that the petitioner herein committed any of the alleged offences. The petitioner only acted as an elder and it also appears that he tried to pacify the persons, who went aggressive against the nephew of the complainant. Hence, in view of the above, it is a fit case to quash the impugned proceedings against the petitioner. 5.
Accordingly, the Criminal Petition is allowed and the proceedings in Crime No.78 of 2011 on the file of Pulivendula Urban Police Station, Kadapa District are quashed to the extent of petitioner herein.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
