THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39229 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to call for records in FIR No.187 of 2016 and to quash the same. Heard and perused the material available on record. The grievance of the petitioner is that the 5th respondent lodged the present complaint on 15.08.2016 against the petitioner, who is an Advocate, alleging that the petitioner, as a counsel to his clients namely Iqbal Islam Khan and others, obtained stay orders in W.P.Nos.22561 of 2008, 27590 of 2008,1155 of 2009, 1156 of 2009, 1666 of 2009 1674 of 2009 & 28647 of 2014 and created bogus documents and subsequently on final hearing, the stay orders were made absolute and that the petitioner has also filed land grabbing case vide LGC No.

39 of 2004 on behalf of his clients and basing on the said false averments made by the 5th respondent and political pressure, a false case was foisted against the petitioner and that the 3rd respondent, under political influence, transferred the case to the 4th respondent on false and fictitious grounds. After arguing for some time, when this Court expressed its opinion that this Court is not inclined to interfere with the investigation since voluminous documents are to be collected by the Investigation Agency and the hand writing as well as signature of the petitioner also to be verified to substantiate the contention of the 5th respondent, learned counsel for the petitioner submitted that the petitioner is ready to co-operate with the investigation.

Considering the grievance of the petitioner and the submissions of the learned counsel for the petitioner, the 4th respondent is directed to complete the investigation in FIR No.187 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law,

without arresting the petitioner. The petitioner is directed to report before the 4th respondent daily between 10.00 a.m. and 5.00 p.m. for a period of fifteen (15) days from 19.12.2016 and the petitioner is directed to give his signature and hand writing to the 4th respondent for the purpose of further investigation in the present crime. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 7th December, 2016 KL
