HON'BLE SRI JUSTICE A. SHANKAR NARAYANA SECOND APPEAL No.1027 OF 1999 JUDGMENT:
No representation when called in the afternoon session.
2. The instant second appeal is directed against the judgment and decree, 2207-1999, in A.S. No.15 of 1995, passed by the learned Senior Civil Judge, Razole, preferred by the appellants herein having got aggrieved by the judgment and decree, dated 20-02-1995, in O.S. No.20 of 1984, on the file of the learned Principal District Munsif, Razole.
3. Earlier, the instant second appeal was directed to be listed under the caption 'for dismissal', by order, dated 29-06-2015. It was adjourned to 30-06-2015, on which date, at the request of the learned counsel for the appellants, the matter was listed to 02-07-2015 under the same caption. On that day, the learned counsel for the appellants argued the matter in part, as such, it was deleted from the caption 'for dismissal', and coming under the caption 'part-heard'. Later, the matter has been adjourned from time to time and on some occasions, there was no representation for the appellants.
4. Hence, the instant second appeal is dismissed for non-prosecution. No order as to costs.
5 . As a sequel thereto, miscellaneous applications, if any, pending in the
appeal, stand disposed of.
