HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 24912 of 2002 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in not extending the retiral benefits to the petitioners as per the revised pay scales notionally as on the date of retirement and the memo dated 28.09.2002, as illegal and arbitrary. A consequential direction is also sought to the respondents to notionally fix the pay of the petitioners in terms of office circular dated 25.05.2001 duly releasing the retiral benefits, namely enhanced gratuity and encashment of earned leave together with interest.
Learned counsel for the petitioners submits that the petitioners are retired employees, but contends that the retiral benefits were not paid to them.
If that be so, the writ petition can be disposed of directing the petitioners to submit a representation to the respondents. Accordingly, the writ petition is disposed of directing the petitioners to submit a representation to the respondents by bringing to the notice of the respondents that the issue raised by them is squarely covered by the orders rendered by this Court in W.P.No.15750 of 2002, dated 22.04.2003, and upon receiving such representation, the
respondents shall pass appropriate orders, in accordance with the rules, in four weeks thereafter.
