HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1158 of 2015 ORDER:

This revision is preferred challenging the order dated 12-06-2015 passed by the I Additional District and Sessions Judge, Srikakulam in Crl.M.P. No.109 of 2015 in Criminal Appeal No.43 of 2015, wherein the learned Sessions Judge while allowing the petition filed by the petitioner invoking the provision under Section 389(1) of Cr.P.C., imposed a condition that petitioner shall deposit the fine amount of Rs.8,05,000/- as imposed by the trial Court.

This Court is of the considered view that if such an order is passed imposing a condition that petitioner shall deposit the fine amount of Rs.8,05,000/- as imposed by the trial Court, it will cause prejudice to the petitioner concerned.

Hence, the order dated 12-06-2015 passed by the I Additional District and Sessions Judge, Srikakulam in Crl.M.P. No.109 of 2015 in Criminal Appeal No.43 of 2015 only to the extent of imposing a condition that petitioner shall deposit the fine amount of Rs.8,05,000/- is hereby suspended.

Accordingly, the Criminal Revision Case is disposed of.

Miscellaneous petitions pending, if any, in this revision shall stand closed.
