Since the subject matter and the grievance in these writ petitions being common, the writ petitions are taken up for disposal by way of a common order; however, the facts in W.P.No.18446 of 2020 are taken for reference. It is the case of the petitioners that they are educational institutions affiliated to 4th respondent-Osmania University, and running Master of Business Administration (MBA) Course. The All India Council for Technical Education (AICTE) had inspected the petitioners-institutions and given approval for enhancement of intake capacity for MBA Course for the Academic Year 20192020 from 120 to 180 seats in view of sufficient infrastructural and instructional facilities available with the institutions.

It is the further case of the petitioners that the 4th respondent-University had also given their No Objection Certificate for issuance of approval letter / Government Order in favour of the petitionersinstitutions so as to notify the enhanced intake capacity of 180 seats in the admission process for the MBA Course. It is the grievance of the petitioners that in spite of the approval obtained by the petitioners-institutions from the AICTE and also from the University, the 1st respondent-Government has not issued a formal Government Order, on account of which the petitioners are deprived of notifying admission for the full intake capacity of 180 seats for the MBA Course. Heard Sri P. Pandu Ranga Reddy, learned counsel for the petitioners; and learned Government Pleader appearing for Higher Education Department.

There is no dispute that the matter with respect to the permission to be granted/issuance of Government Order is pending before the Government.

the petitioners are running educational institutions, and the common contention of the petitioners being that adequate infrastructural and instructional facilities are available with their institutions and the AICTE and also the 4th respondentUniversity has given approval/No Objection for enhancement of intake capacity to 180 seats for MBA Course in the petitioners-institutions, the 1st respondentState shall pass appropriate orders, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Subject to the above direction, the writ petitions are disposed of. No costs.
