Mohammed Fasi Khan v. The State Of Telangana
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI WRI T PETI TI ON No.30746 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition, filed for production of Nabeela Soofi, the wife of the petitioner, and for her release through a writ of Habeas Corpus, was taken up by way of a Lunch Motion.
Learned Assistant Government Pleader attached to the office of the learned Advocate General, State of Telangana, placed before us a copy of the statement dated 12.09.2016 addressed by the alleged detenu, Nabeela Soofi, to the Inspector of Police, Langer House Police Station, Hyderabad, wherein she said that she was not being detained against her will. However, to confirm that no pressure was being brought to bear upon the alleged detenu to leave the country with her parents, we directed the police authorities to produce the alleged detenu before us. The alleged detenu, Nabeela Soofi, appeared in person before us and in camera proceedings were held. During her interaction with us, Ms. Nabeela Soofi informed us that she is aged 21 years and she is leaving to Saudi Arabia out of her own free will along with her parents and that no pressure was being brought upon her in this regard. She further stated that she did not wish to meet the petitioner or speak to him. Ms. Nabeela Soofi was firm in her decision though she appeared a little disturbed.
In that view of the matter, we find no reason to entertain this writ petition or adjudicate the same. The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
