Prasenjit Biswas, v. The State Of Telangana

2019-09-17G Sri Devi3 pages

HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 5308 of 2019 ORDER:

1.

The petitioners/accused Nos.1 and 2 filed the present application under Sections 437 and 439 of Criminal Procedure Code, seeking to grant bail to them in NCBF No.48/1/7/2018/NCB/SUBZONE/HYD of Narcotics Control Bureau, Hyderabad Sub-Zone, which was registered for the offences punishable under Sections 8(c) read with 20(b), 28 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "the Act"). 2.

Heard learned Counsel for the petitioners and learned Special Public Prosecutor appearing for the respondent-State.. 3.

As seen from the record, in the first bail application i.e. Crl.P.No.2942 of 2019 dt.02.08.2019, this Court rejected granting bail on merits by elaborately discussing the case and now it seems there are no new grounds whatsoever assigned in this bail application to consider granting bail. Since the first bail application supra was dismissed on merits, the learned counsel for the petitioners submits that the charge sheet is already filed and the trial Court took cognizance of the offences and prays the Court that reasonable time may be fixed to dispose of the case by the trial Court. 4.

Looking into the facts and circumstances of the case, the trial Court is hereby directed to commence trial on day-to-day basis

without giving any unnecessary adjournments to either of the parties and shall conclude trial as expeditiously as possible preferably within the period of four months from today.

5. Accordingly, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
