This Civil Revision Petition is directed against docket order dated 09.12.2014 in O.S.No.7 of 2010, wherein the Court below treated the cross-examination of D.W.4 as nil and closed the defendant's evidence and the main suit is posted for arguments on 29.12.2014.
Learned counsel for the petitioner states that he require time for submitting arguments in the suit before the Court below. However, he has not pointed out any error or infirmity in the docket order dated 09.12.2014 passed by the Court below. He would further contend that the evidence of D.W.2 is closed on the ground that she is suffering with cancer, which is not true.
These are all the aspects which the petitioner has to place before the Court below and he has to request the Court below to grant time for putting forth his arguments. It is the discretion of the Court below to grant time for advancing arguments by the petitioner.
In view of the above facts and circumstances, I do not see any error or infirmity in the order passed by the Court below warranting interference under Article 227 of the Constitution of India.
Accordingly, Civil Revision Petition is dismissed. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in this Civil Revision
Petition, shall stand dismissed.
