THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.18686 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) The prayer of the petitioner in this case was for a writ of habeas corpus to produce his son, Ganta Chandra Sekhar Sreenivasa Santosh, before this Court and release him into the petitioner's custody.
Learned Special Government Pleader representing the learned Advocate General, State of Andhra Pradesh, informed this Court that the missing boy was traced out and his custody was handed over to his father, the petitioner herein. The 5th respondent, the Principal of the school in which the petitioner's son was studying, filed a counteraffidavit. The petitioner seeks to rebut the afore-stated counter-affidavit averments by way of affidavit dated 22.08.2016. However, this Court is of the considered opinion that the disputes, if any, between the petitioner and the 5th respondent, are not amenable to the writ jurisdiction of this Court. All the more so, when the case was filed for a writ of habeas corpus and it has served its purpose.
The Writ Petition is accordingly closed leaving it open to the petitioner to seek redressal of his grievance, if any, vis-à-vis the 5th respondent before the appropriate form in accordance with law. No order as to costs.
