HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.11658 of 2009 ORDER:

The relief sought for in this Writ Petition is to declare the action of the District Panchayat Officer, Prakasam District, Ongole-1st respondent, in issuing proceedings dated 10.06.2009 declaring the petitioner as disqualified to continue as the 1st Ward Member of Kunamnenivaripalem Gram Panchayat, as illegal and arbitrary. The petitioner contested for the election as a Ward Member of the 1st Ward, Kunamnenivaripalem Gram Panchayat on 28.07.2008. The period of office of a ward member is five years. By way of an interim order, passed in WPMP No.15021 of 2009 dated 16.06.2009, the impugned order passed by the District Panchayat Officer, Prakasam District, Ongole-1st respondent dated 10.06.2009 was suspended. Consequently, the petitioner continued to hold office for the entire term, which expired in the year 2014. As the term of office came to an end nearly three years ago, it is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court.

The Writ Petition is, accordingly, dismissed as infructuous. The Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
