This writ petition is filed seeking to declare the proceedings in Rc.No.B/218/2006, dated 4.02.2006, issued by the third respondent as illegal, arbitrary and consequently direct the respondents not to issue any document by changing the name of the petitioner in respect of the land in an extent of Ac.8.30 guntas in Sy.Nos.20/1 and 20/1-1, situated at Korvichelma village, Dandepally Mandal, Adilabad District. 2.

It is seen from the record that the Memo dated 4-02-2006 issued by the third respondent is under challenge. The said Memo is a communication to the petitioner on his representation dated 4-02-2006. It is stated in the said Memo that the petitioner has sold the lands to 4th respondent on 17-02-1985 by way of an unregistered sale deed and since then, 4th respondent is in occupation of the said lands and doing cultivation and the name of the purchaser has been recorded in cultivation column of pahanies with effect from 1985. Further, the petitioner represented the matter before the Revenue Divisional Officer, Mancherial on 8-02-2006 and the third respondent also called for objections for participating in the enquiry with regard to change of Record of Rights and patta by giving 15 days time. 4.
In the counter affidavit, it is stated that the unregistered sale deed has been impounded by the Revenue Divisional
Officer, Mancherial by order dated 7-02-2006 in favour of 4th respondent.

In view of the facts and circumstances of the case, this Court cannot decide the issue of title and also carrying out the entries in Revenue Records, in the present writ petition filed under Articles 226 of the Constitution of India. 6.
Accordingly, the writ petition is dismissed, giving liberty to the petitioner to avail appropriate legal remedies available under law. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
