THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9416 of 2016 ORDER:

This Writ Petition is filed seeking a writ of mandamus to declare the action of the official respondents No.3 to 5 in not acting upon the representation made by the petitioner, dated 10.03.2016 about the illegal construction made by the 6th respondent in contravention of Section 121 of the Panchayat Raj Act, 1994 (in short "the Act"). The grievance of the petitioner is that the 6th respondent is proceeding with the construction without obtaining sanction from the 5th respondent-Gram Panchayat.

Learned Government Pleader for Gram Panchayat submits that the 6th respondent has been issued notices to stop the construction and necessary action is being taken.

Recording the submission of the learned Government Pleader for 5th respondent and in the admitted facts of the case that 6th respondent had not obtained any permission for construction, the 5th respondent shall ensure no violation of the provisions of the Act by the 6th respondent in making constructions.

Accordingly, the Writ Petition is disposed of. As a sequel, pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
