THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.8561 OF 2017 ORDER:

Petitioner was appointed as Field Assistant of Mosuru Gram Panchayat, Pachipenta Mandal, Vizianagaram District.

On 16.02.2017, the petitioner was served with a show cause notice calling upon him to submit explanation for the illegalities alleged to have been committed by him. While calling for explanation on the allegations, the petitioner was also placed under suspension. The petitioner is aggrieved by the said order of suspension from service. 2.

The allegations proved are grave. Thus, this Court is not inclined to entertain the Writ Petition and examine the validity of the allegations levelled against the petitioner, at this stage. The petitioner is provided sufficient opportunity to refute the allegations and after exhausting the remedies available within the organisation, he can avail the judicial remedy. 3.

Further, Clause 13 of the Field Assistants Human Resource Policy, dated 08.01.2013, provides right of appeal against the order of suspension to the District Collector and such appeal is not preferred by the petitioner. Hence, this Court is not inclined to entertain the Writ Petition, since efficacious remedy is available to the petitioner.

The Writ Petition is accordingly dismissed leaving it open to the petitioner to file her explanation on the charges levelled against

him and to avail the remedy of appeal, if so advised against the order of suspension. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
