HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TRANSFER C.M.P.No.73 of 2015 ORDER:

This petition is filed under Section 24 C.P.C., to withdraw O.S.No.12 of 2014 from the file of the Judge, Family Court, Ranga Reddy District, at L.B.Nagar, and transfer the same to the Family Court, Nellore, for disposal in accordance with law.

2. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondent and perused the material available on record.

3. At the time of arguments, both counsels in one voice submitted that O.S.No.12 of 2014 is filed by the respondent herein for declaration to declare him as the owner of the suit schedule property. Both counsels in one voice submitted that the petitioner herein filed F.C.O.P.No.216 of 2013 on the file of the Family Court, Nellore seeking maintenance from the respondent. Both counsels further submitted that the respondent herein filed F.C.O.P.No.42 of 2015 on the file of the Family Court, Secunderabad for dissolution of marriage between him and the petitioner. Both counsels requested this Court to transfer O.S.No.12 of 2014 on the file of the Family Court, Ranga Reddy District, at L.B.Nagar to Family Court, Secunderabad in view of pendency of F.C.O.P.No.42 of 2015.

In view of the submissions made by both counsels and also in the interest of both parties, I am inclined to withdraw O.S.No.12 of 2014 pending on the file of Family Court, Ranga Reddy District, at L.B.Nagar and transferred the same to Family Court, Secunderabad, for disposal in accordance with law. As a sequel, miscellaneous petitions, pending if any shall stand closed.
