Petitioner is aggrieved by the order of suspension dated 20.09.2016 passed by the Commissioner of Intermediate Education, Hyderabad (1st respondent). Various contentions are urged in support of the prayer sought in the writ petition. However, as it is noticed from the pleadings no appeal is preferred against the decision of the 1st respondent. Rule 33 of the Andhra Pradesh Civil Services (CCA) Rules, 1991 provide right of appeal to the next higher authority. The said remedy is an efficacious and effective remedy. Therefore, this Court is not inclined to entertain the writ petition at this stage.

Leaving it open to the petitioner to avail the remedy of appeal, the writ petition is disposed of. It is needless to observe that as and when such appeal is preferred, the same shall be considered objectively and appropriate orders be passed, within a period of two (2) months from the date of receipt of such appeal. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
