THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.32945 and 33384 of 2015 COMMON ORDER:

These two Writ Petitions are being disposed of by this common order in view of the grievance in the Writ Petitions being the same. The petitioners are Degree and PG Colleges running their colleges in Karimnagar District. The colleges are offering degree courses in various branches. The second respondent, considering the representation of the Nalgonda District Private Degree & PG Colleges Managements Association, issued proceedings on 06.08.2015 communicating the Registrars of six Universities, including the Sathavahana University, Karimnagar District, enabling the Universities to permit additional intake in a given section in a college to the extent of not more than 20% of the sanctioned intake if there is a genuine demand, only for that particular academic year duly informing the second respondent.

Accordingly, the Universities were informed to intimate the enhancement of intake to the Managements/Principals of all colleges under their jurisdiction of the University and take further necessary action. The classes in the petitioners colleges were commenced on 15.06.2015 and the petitioners applied for affiliation on 03.10.2015. As per the circular issued by the third respondent on 04.09.2015 the colleges have to submit the student information to the University online between 04.09.2015 to 30.09.2015, which was extended up to 08.10.2015. The petitioners submitted the applications on 03.10.2015 and 25.07.

for the courses specified therein by 30% for the academic year 2015-2016, and the third respondent has not communicated any decision thereon. In those circumstances, the present Writ Petitions are filed. It is submitted by the learned Counsel appearing for the third respondent that the last date for uploading the information was 30.09.2015, but the last date was relaxed in the case of colleges situated in remote areas and the said relaxation is not applicable to the petitioners. But, the petitioners in W.P.No.32945 of 2015 submitted their representation on 03.10.2015, whereas the petitioners in W.P.No.33384 of 2015 submitted their representation on 25.07.2015 and the same are pending. In view of the pendency of the representations, the petitioners could not upload the information.

In the circumstances, the third respondent is directed to take into consideration the circular issued by the second respondent with regard to the enhanced intake and pass necessary orders within a period of three days from the date of receipt of a copy of this order, based on which, the petitioners are enabled to upload the information of the students, within two days thereafter. The Writ Petitions are, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed.
