HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 979 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the appellant prays for withdrawal of this appeal with liberty to the appellant to file review petition. On last occasion (04.11.2015), learned counsel for the appellant sought time to file additional affidavit placing on record whether ground of challenge
raised by him in paragraph '6' of the affidavit in support of the prayer in the writ petition, was, in fact, argued before learned Single Judge. Affidavit has not been filed. Learned counsel submits that he appeared in the matter before learned Single Judge and he argued this ground of challenge. In view thereof, he seeks liberty to file review petition, as aforementioned. Writ appeal is disposed of as withdrawn with liberty as prayed. All contentions of the appellant are kept open.
