THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12555 of 2016 ORDER:

Heard Sri Ravulapati Sreenivasa Rao, learned counsel for the petitioners, and Sri N. Praveen Kumar, learned Standing Counsel for the Kodad Municipality.

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit that it is prayed that the Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of WRIT OF MANDAMUS, declaring the action the Respondent No. 2 in issuing the Special notice of property tax, vide its no: 1180009610, dt: 24-11-2015 and issuance of demand bill dated 03-12-2015 as illegal, arbitrary and violative of the rights guaranteed under the Constitution of India and consequently set aside the same and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."

Though the petitioners are aggrieved by the special notice of property tax dated 24.11.2015 and demand notice dated 03.12.2015 issued by the municipal authorities, they have not even chosen to file a representation before the municipal authorities or prefer a revision under the statutory rules. Without first approaching the authorities concerned, it is not open to the petitioners to straightaway approach this Court by way of a writ petition.

The writ petition is accordingly dismissed on this short ground. This order shall however not preclude the petitioners from approaching the municipal authorities for redressal of their grievance in accordance with law.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
