THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION NO.25434 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to declare the action of the officials working under respondent No.4 in calling into the police station to settle money disputes as illegal and arbitrary and consequently direct the 4th respondent not to call and insist the petitioner to settle civil disputes in the police station."
2. When the matter is called today, written instructions, dated 20-08-2015 furnished by the Inspector of Police, Manghalhat Police Station, Hyderabad City, have been placed on record by the learned Government Pleader for Home. The said instructions, read as under: "It is respectively submitted that on 08-08-2015 this respondent received a oral complaint from one Mr.Mirza Mustafa Baig of Zebabagh, Asifnagar against the petitioner herein, stating that the petitioner is threatened him with dire consequences that he will kill him, after that the petitioner's brother Mohd. Azeemuddin also came to this police station and reported against Mirza Mustafa Baig. Then this respondent enquired about the subject matter to both of them, in the enquiry it is revealed that the matter pertains to financial transaction seems to be civil in nature, hence, this respondent suggested to approach competent civil court for redressal.
It is respectively submitted that the petitioner contended that the police are insisting the petitioner to come to police station to settle the money dispute with Mirza Mustafa Baig, when he refused to go to the police station, the police constables have taken away his younger brother Mohd. Azeemuddin and detained him in the police station from morning till evening on 08-08-2015, is totally false and baseless, because this respondent or officials of this respondent police station never called the petitioner to the police station or his brother and detained in the police station are false and baseless allegations, hence denied.
Hence, all the allegations made by the petitioner in the present writ petition against this respondent, is totally false and baseless, hence denied."
3. On noticing the said instructions, learned counsel for the petitioner requested to dispose of the writ petition by recording the said instructions.
4. In view of the above, writ petition stands disposed of by recording the written instructions, dated 20-08-2015 furnished by the Inspector of Police, Manghalhat Police Station, Hyderabad City. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
