THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6543 of 2012 ORDER:
The grievance of the petitioner was that the police authorities were not registering a crime and conducting an investigation upon his complaint.
Relying on the written instructions dated 12.08.2015 received from the Inspector of Police, Pet Basheerabad Police Station, Cyberabad, the learned Assistant Government Pleader for Home informed this Court that upon the petitioner's complaint lodged with the police, Crime No.8 of 2012 was registered under Section 174 Cr.P.C. (suspicious death) on the file of Pet Basheerabad Police Station, Cyberabad. The Investigating Officer conducted an inquest over the dead body which was also subjected to post-mortem examination. The Doctors who conducted the said examination opined that the cause of death was due to hanging. As per the statements of witnesses and relations, the allegations of the petitioner/complainant were not established against the accused as no suspicious circumstances were found surrounding the death.
The police therefore concluded that it was a case of suicidal death by hanging. Following the due procedure, a final report under Section 173 Cr.P.C., was filed before the learned II Class Executive Magistrate, Qutubullapur, Cyberabad, in May, 2012. In the light of the aforestated developments, the allegation of the petitioner that the police remained inactive upon his complaint is shown to be without basis. In the event the petitioner is aggrieved by the final conclusion arrived at by the police authorities, it is for him to take recourse to appropriate measures in accordance with law before the concerned forum.
Reserving liberty to the petitioner to do so, the writ petition is closed.
Pending Miscellaneous Petitions, if any, shall also stand
closed. No order as to costs.
