THE HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.4703 of 2009 ORDER:
Heard Mr.Shyam S.Agarwal for revision petitioner. Notice on respondents though served none appears for respondents. The decree holder is the revision petitioner. The revision petitioner in E.A.No.283 of 2008 prayed for withholding an amount of Rs.51,655/ - from the account of judgment debtor-1st respondent. The learned trial Judge through the order impugned in the Civil Revision Petition has rejected the prayer. Hence, the Civil Revision Petition.
On 04.02.2010, this Court granted interim direction as prayed for. The interim order is subsisting. By virtue of the interim order granted by this Court, the very prayer both in the Civil Revision Petition and E.A. is substantially considered. At this stage of execution, this Court is of the view that Civil Revision Petition can be disposed of by making the interim order dated 04.02.2010 absolute with a further direction to the Executing Court to dispose of E.P.No.103 of 2008 within eight weeks from the date of receipt of a copy of this order.
With the above direction, the Civil Revision Petition is disposed of. No order as to costs.
