HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 20578 of 2016 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Roads and Buildings.

The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the action of the respondents in trying to demolish the house of the petitioner bearing Door No.1-2 in Sy.No.309/5 of Peddagaruvu Village, Bheemavaram Mandal, West Godavari District, for the purpose of widening of road without issuing any notice or any land acquisition proceedings, as illegal, arbitrary and violative of principles of natural justice; and consequently direct the respondents not to demolish the petitioner's house without following due process of law.

Though various grounds are raised learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to follow due process of law. Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the respondents not to interfere with the subject property in

the context of road widening except in accordance with the due procedure laid down by law. No order as to costs.
