THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.70 OF 2000 JUDGMENT:

This Second Appeal is filed, by the plaintiff, under Section 100 of C.P.C., assailing the judgment and decree dated 18.11.1999 passed in A.S.No.27 of 1996 on the file of the Court of the Senior Civil Judge at Sompeta, wherein and whereby the judgment and decree dated 20.12.1995 passed in O.S.No.111 of 1989 on the file of the Court of the District Munsif, Palasa, decreeing the suit filed by the plaintiff for recovery of possession of the suit schedule house after evicting the defendant therefrom, was set aside. Learned counsel for the appellant submitted that there are no instructions from the appellant since long time. It appears that the appellant is not interested to prosecute the appeal.
