HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.14125 of 2015 PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Mr. N. Praveen Kumar, learned Standing Counsel for respondent No.2, at the outset, invited our attention to Rule 12 of the Taxation and Finance Rules, and submitted that a revision against the demand of tax, impugned in the present writ petition, is maintainable. Having confronted with this, Mr. Srinivas Reddy Balakisti, learned counsel for the petitioner, prays for withdrawal of the writ petition with liberty to the petitioner to challenge the impugned demand by way of revision.

The writ petition is disposed of as withdrawn with liberty as prayed. If the revision is filed within a period of two weeks from today, the revisional authority shall consider and deal with the same on merits, in accordance with law, without entering into the issue of limitation.

Consequently, pending miscellaneous applications shall also stand closed.
