HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1659 OF 2017 ORDER:

The case of the petitioner is that his vendor purchased the subject land through an auction conducted by the 5th respondent and that sale certificate was also issued to that effect. While so, when the petitioner intend to purchase said land from his vendor, both of them approached the 4th respondent and requested to receive the sale deed and process the same. But, the 4th respondent rejected to receive the said document. Aggrieved by the same present writ petition is filed.

Learned counsel for the petitioner also relied on the Judgment of Division Bench in WA.No.950 of 2007. Heard learned Assistant Government Pleader for Revenue.

In view of the aforesaid facts and circumstances and in view of the Division Bench Judgment in WA.No.950 of 2007, it is open for the petitioner to present the document before the 4th respondent for registration and on such submission, the 4th respondent is directed to receive the same if the same is in order as per provisions of Indian Stamp Act and Registration Act and the rules made thereunder and register the same considering the sale certificate. If he wants to

refuse to register the same, he shall record reasons as per Section 71 of the Registration Act and communicate the same to the parties.

Accordingly, the writ petition is disposed of. No order as to costs.
