THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 28264 of 2012 ORDER :

Heard learned counsel for petitioner, Mr. J.

Prabhakar, standing counsel for respondent Nos.1 and 2, and the Government Pleader for Housing appearing for respondent No.3.

2. Learned counsel appearing for the parties submit that pursuant to the interim order passed by this Court on 29.12.2015, the parties, having regard to the peculiar facts and circumstances of the case, have worked out the grievance complained in the writ petition.

Mr. J. Prabhakar submits that the respondents will adjust the excess amount paid by the petitioner towards corpus fund payable by the petitioner. According to the petitioner, the benefit he is entitled to works out to Rs.75,000/- and the corpus fund payable by him is Rs.57,000/-.

3. By placing the above submissions on record, the writ petition is disposed of directing the respondents to adjust towards payment of corpus fund a sum of Rs.57,000/- from Rs.75,000/- paid by the petitioner. With such adjustment, it is recorded that the grievance canvassed in the writ petition is substantially worked out.

It is made clear that this Court has not considered the grievance on merits. Consequently, the disposal cannot be treated as a precedent on the right of a person who has paid the excess amount to the respondents for adjustment or repayment.

4. The writ Petition is disposed of, as indicated above. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. ____________________ JUSTICE S.V.
