HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5432 of 2019 ORDER :

This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, aggrieved by the action of the VII Addl. District and Sessions Judge, R.R. District at L.B.Nagar, in not disposing of the Crl. Appeal No.363 of 2014 filed by the petitioner-A3 and other accused (A1 and A2).

As seen from the record, the learned VII Metropolitan Magistrate, Cyberabad at Hayatnagar, vide judgment, dated 22.04.2014 in C.C.No.589 of 2011 convicted A1 to A3 for the offence punishable under Section 326 r/w 34 IPC and accordingly, A1 was sentenced to undergo S.I. for one year and to pay a fine of Rs.500/-, in default to undergo S.I. for 5 days and A2 and A3 were sentenced to undergo S.I. for six months each and to pay a fine of Rs.500/- each, in default to undergo S.I. for 5 days each. Challenging the said conviction and sentence, A1 to A3 filed Crl.A.No.363 of 2014 before the appellate Court.

During the course of arguments, the only relief sought for by the learned counsel for the petitioner-A3 is that a direction may be given to the learned VII Addl. District and Sessions Judge, R.R. District at L.B. Nagar, to dispose of the appeal at the earliest.

In the light of the prayer made by the learned counsel for the petitioner-A3, the learned VII Addl. District and Sessions Judge, R.R. District at L.B. Nagar, is hereby directed to dispose of Crl.A.No.363 of 2014 on his file, as expeditiously as possible, preferably within a period of 3 months from the date of receipt of a copy of this order. 5.

With the above direction, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
