This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in FIR No.441 of 2026 of Pet-Basheerabad Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 80 and 85 of the BNS and Section 3(2)(va) of the SC/ST (POA) Act.

The case of the prosecution is that the de-facto complainant lodged a complaint on 27.03.2026 stating that 8

months back her elder daughter was got love marriage with the petitioner. After marriage they both were residing at Srinivas Nagar colony, Kompally and doing private job. On 27.03.2026 at 09.50 hours their son-in-law Laxmi Narsaiah Naidu contacted to complainant husband and informed that their daughter was committed suicide by hanging.

Immediately, the complainant started from their native place and informed to their relative person kantam Yesanna, then he proceeded to Srinivas Nagar colony, Kompally and noticed that complainant's daughter was hanging to ceiling fan in her bed room with blue color saree, and died. The Complainant stated that recently they held their younger daughter marriage. From that onwards their elder daughter has been harassed by the petitioner by demanding extra dowry from her parents and he also bet her daughter. Due to which she disgusted her life and committed suicide. Hence, the complainant requested for necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri V. Yadu Krishna Sainath, learned counsel representing on behalf of the Petitioner as well as Sri M.

Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent -State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and in fact, the marriage of the petitioner and the deceased was performed in the month of February, 2025 and they were in love and were in relationship since 2024. He further submitted that neither the parents of the deceased nor those of the petitioner had consented to their marriage, and consequently, both the petitioner and the deceased were not in contact with their parents, as such, there is no question of demand of additional dowry arises. He further submitted that the petitioner is in jail since 29.03.2026 and the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner are serious in nature. He further submitted that notice is served to the victim. He further submitted that

the marriage of the petitioner and the deceased was performed in the year 2025 and within eight months of the marriage, victim committed suicide due to harassment of the petitioner for additional dowry. Further, the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since 29.03.2026 and as seen from the remand case diary, the prosecution witnesses, LWs 1 to 13 have already been examined. Further, the marriage of the petitioner with the victim is a love marriage. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the

satisfaction of learned IX Additional Judicial Magistrate of First Class, at Medchal.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
