THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8914 OF 2005 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ, order or direction more particularly one in the nature of writ of mandamus, to declare the proceedings of the Correspondent, S.G.S.M.Aided Upper Primary School, Sastry Nagar, Badvel, in Rc.No.18/98, dated 07-05-1999 is illegal, without jurisdiction and opposed to principles of natural justice and further direct the respondents to extend the benefits of G.O.Ms.No.180, Education (Ser.III) Department, dated 30-12-2004 to the petitioner and take him back into service with all consequential benefits, and pass such other order or orders in the interest of justice."

When the matter is called, it is submitted by the learned counsel appearing for the petitioner that the case of the similarly situated persons was considered by the State Government and orders were also passed in their favour. It is further submitted by the learned counsel for the petitioner that petitioner herein may be permitted to make an application to the State Government for redressal of his grievance and the same may be directed to be disposed of by fixing some timeframe. On the otherhand, the submission of the learned Government Pleader is that if any such

AVSS,J W.P.No.8914 of 2005 representation is made by the petitioner, the same will be considered in accordance with law.

For the aforesaid reasons, without going into merits and demerits of the matter, Writ Petition stands disposed of, permitting the petitioner to submit an appropriate application before the 1st respondent for redressal of his grievance, within a period of one month from the date of receipt of a copy of this order. If any such application is filed within the time stipulated above, the same shall be considered and appropriate orders be passed in accordance with law, within a period of three months from thereafter.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
