HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.6799 of 2011 ORDER:

This criminal petition is filed seeking to quash the proceedings in C.C.No.66 of 2011 on the file of XI Additional Chief Metropolitan Magistrate, Secunderabad, registered for the offences under Sections 138 and 142 of the Negotiable Instruments Act. The accused and the complainant are having business relationship in terms of apparels and its ancillary supplies and in the process of transaction, the petitioners/accused issued cheques and the same were returned with an endorsement "payment is stopped by the drawer".

It is not for this Court to go into the reasons for the stoppage of payments by the petitioners having issued cheques. This Court sees no reason to interfere and stall the proceedings before the Court below.

The criminal petition is accordingly dismissed. Needless to observe that interim stay earlier granted stands vacated. As a sequel, miscellaneous petitions if any pending stand closed.
