This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the respondents in digging the bore-well in R.S.No.81/4 Ch.Pothepalli Village, Dwaraka Tirumala Mandal, West Godavari District as per the proceedings of the second respondent vide Roc.No.D2/18/2011 dated 24.07.2014 as illegal, arbitrary and violative of Articles 14, 21 and 300A of Constitution of India and consequently to direct the respondents to dig the bore-well in the above said land. Heard the learned counsel for the petitioner and the learned Government Pleader for Panchayat Raj and Rural Development. The predominant contention of the learned counsel for the petitioner is that the petitioner belongs to S.C. Community. On 24.07.
2014, the second respondent issued proceedings for digging of bore-wells in the lands of the persons, who belong to S.C. and S.T. community. The petitioner's` name was shown at Serial No.57 in the list as one of the beneficiaries. The petitioner also made a representation on 23.05.2016 to the second respondent, who in turn forwarded the same to the third respondent, to direct the Panchayat Raj officials to dig the tube-well in the land of the petitioner. The only relief sought by the petitioner is to direct the third respondent to dispose of his representation dated 23.05.2016. Having regard to the facts and circumstances of the case, the third respondent is hereby directed to consider the representation of the petitioner dated 23.05.2016 and pass appropriate orders in the light of the proceedings of the second respondent dated 24.07.
2014. Accordingly, the Writ Petition is disposed of. No costs.
Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
